Evidence Must Be Provided Before Hearing

The N.Y.C. Human Resources Administration is ordered to (1) provide fair hearing appellants a copy of the evidence package to be used against them, or other specifically identified documents from their public assistance files, within 3 business days of a telephone or written request; and (2) provide in all notices information regarding the right to obtain such evidence, including a working phone number or address where such evidence may be obtained. The court further ordered that the agency withdraw notices in the event that they fail to provide evidence. Clearinghouse Number pending.
